These Terms & Conditions (“Terms”) govern your use of the Kilford Auctions LLC website and your participation in our online auctions. By registering for an account, placing a bid, or otherwise participating in any Kilford Auctions auction, you accept and agree to these Terms. If you do not agree, please do not register or bid.
About Us
Kilford Auctions LLC is a public online auction company located at 7209 Charter Oak Loop, Temple, TX 76502. We specialize in overstock, new, and box-damaged merchandise from major retailers. You can reach us at support@kilfordauctions.com or (254) 551-1089.
Registration & Bidding
- You must register and provide accurate, current contact and payment information to bid. You are responsible for keeping your account information up to date.
- All lots start at $5 with no reserve and no minimum, unless otherwise stated in the lot description.
- All bids are binding offers to purchase. Once placed, a bid cannot be retracted. The highest bid at the close of a lot wins, subject to these Terms.
- Lots close at a staggered rate on the scheduled closing day, as indicated in each auction.
- You are responsible for all activity placed under your account.
Payment
- Immediately after an auction closes, we will process the payment method on file for any lots you have won.
- Your total will include the winning bid amount, a buyer’s premium of 14%, and applicable Texas state sales tax. Premium and tax rates are disclosed at registration and may be updated from time to time.
- You will receive a confirmation email with a copy of your paid invoice. Invoices are sent from support@kilfordauctions.com; if you do not see it, please check your junk/spam folder.
- If a card on file fails to process, we will send an invoice that can be paid online or in person. Items are not released until payment is received in full.
- Sales tax exemptions require a valid resale or exemption certificate on file prior to invoicing.
Pickup
- Items cannot be paid for or picked up until the auction has completed in its entirety.
- After the auction closes and invoices are created, you will receive an emailed invoice and a text message confirming you are a winning bidder, typically about one hour after the auction concludes.
- Each auction has designated pickup days and hours, listed in the auction details. Please bring your invoice.
- We will assist in moving your items from inside the auction house to your vehicle. Due to insurance requirements, our employees cannot assist in strapping down or securing items transported on the outside of a vehicle.
Shipping
- We ship. Shipping is available for most items at the buyer’s expense.
- For your protection and ours, and to meet credit-card security requirements, every package is shipped to the address on file with your HiBid registration. If your address is not current, please update it in HiBid before the auction closes. If you need to ship to a different address, we may require a copy of your photo ID to verify your identity before we ship.
- Winning lots must be paid in full before we package, weigh, and invoice for shipping. Your shipping invoice includes insurance equal to the amount you bid. Once shipping has been paid, we will provide tracking information.
- You may provide a prepaid shipping label instead. Email your request for box dimensions and weight to support@kilfordauctions.com, then email the prepaid label to the same address.
- Salvage lots and mirrors larger than handheld cannot be shipped. All such sales are final.
- Items for which shipping has not been paid, or for which a prepaid label has not been received, by the final pickup day will be forfeited, and the bidder will not be eligible for a refund. Kilford Auctions is not responsible for removal of forfeited items.
Item Conditions & As-Is Sale
- All items are new unless otherwise stated in the lot description. Packaging may show signs of warehouse handling, damage, or processing stickers, and items may have been opened for inspection and resealed.
- The lot condition is listed FIRST in each item’s description — please read it before bidding. We do not control what inventory is sent to us; our staff does its best to inspect each item and verify condition, and we test for functionality when we are able.
- Items described as NOT TESTED or UNABLE TO TEST are sold as-is with no returns and no refunds. Please preview or ask questions before bidding on them.
- About our photos: the first image on many lots may be a lifestyle/stock photo showing the item in use or as seen in stores. We try to include our own photos of the actual item you will receive in every lot. Please review all photos before bidding.
- All merchandise is sold AS-IS and WHERE-IS, without warranties or guarantees of any kind, express or implied. Kilford Auctions does not represent any manufacturer or retailer.
Returns & Refunds
We stand behind what we sell. Please read this section before bidding.
- When we accept returns: We accept returns and refunds only when we misrepresented an item, and only when requested within 14 days of the auction close date. After that window closes, returns for that auction can no longer be accepted, so we can finalize each auction before the next one closes.
- Condition: To receive a refund, the item must be returned in the same condition in which it was sold, with all original parts and packaging.
- Return shipping: When we misrepresented an item, we cover return shipping.
- Refunds: Approved refunds are issued to your original payment method within 5 business days of our receiving the item back in the agreed condition.
- Not tested / unable to test: Items described as NOT TESTED or UNABLE TO TEST are sold as-is with no returns and no refunds.
- Salvage & large mirrors: Salvage lots and mirrors larger than handheld cannot be returned and cannot be shipped. All such sales are final.
- Preview & questions: We encourage you to set a preview appointment and inspect the items you want to bid on. You can also email or text us with questions — we respond as quickly as we can.
Because this is an auction, we do not offer returns or refunds for buyer’s remorse, sizing, color, change of mind, or any reason other than our own misrepresentation of an item. Please make sure each lot is the right size, color, shape, and model before you bid.
Communications & Text Messaging
By providing your phone number during registration, bidding, checkout, or sign-up, you may receive operational communications from Kilford Auctions, including email and SMS text messages about bidding, auction closings, invoices, payments, pickup, and shipping. Message frequency varies; message and data rates may apply. You can opt out of text messages at any time by replying STOP, and reply HELP for help.
For full details, please review our SMS Notifications Policy and our Privacy Policy. Mobile phone numbers and SMS opt-in data are never sold or shared with third parties or affiliates for marketing purposes.
Limitation of Liability
To the fullest extent permitted by law, Kilford Auctions LLC, its owners, and its employees are not liable for any indirect, incidental, or consequential damages arising from your participation in an auction, the use of our website, or the purchase, pickup, shipping, or use of any item. Our total liability for any claim will not exceed the amount you paid for the item giving rise to the claim.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or your participation in our auctions will be subject to the exclusive jurisdiction of the state and federal courts located in Bell County, Texas.
Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted on this page, and the “Last updated” date above will be revised. Your continued participation after changes are posted constitutes acceptance of the updated Terms.
